How Long Does USCIS Take to Respond to an RFE After a DNA Test?
USCIS response times to a Request for Evidence (RFE), such as those related to Form I-797 or I-130, vary considerably. Based on our experience with clients who submitted DNA testing evidence, the average response time from USCIS ranges between 30 and 90 days. In some cases, processing may take longer.
USCIS does not publish an official timeline for responding to petitioners after receiving additional evidence. We recommend allowing at least 30 days for USCIS to process your response. After this period, contact USCIS to check your case status.
What Happens After Submitting an RFE DNA Test Result?
Once you submit your response to the RFE, a USCIS officer will review the additional evidence. The officer may conduct further investigation of the documents and answers provided. Your petition remains under evaluation during this period.
Case re-evaluation after an RFE can take several months. In most cases, USCIS issues a decision within six to seven months of receiving the RFE response. Outcomes may include approval, a request for more evidence, a Notice of Intent to Deny, or, less commonly, a direct denial.
Consider consulting an immigration attorney if you need assistance communicating with USCIS or responding to an RFE.
