Frequently Asked Questions

Yes. Legal Avuncular DNA tests in New York are court admissible. Our partner laboratory is AABB accredited and New York State Department of Health (NYSDOH) certified both are required for results to be accepted in Family Court.

No, an aunt or uncle cannot perform a DNA test without receiving consent from the child’s mother or legal guardian. If an aunt or uncle is the legal guardian of a child under the age of 18, they can perform a DNA test without the mother’s consent in New York State.

Aunts and uncles must provide the documents prior to scheduling a DNA testing appointment if they are a legal guardian.

  • Proof of legal guardianship
  • Prescription referral for all testing participants.
  • Or a court order or a letter requesting a DNA test be performed by a NYS licensed attorney.

Below are the differences between a Legal DNA Test and At Home Uncle and Aunt DNA Test.

Legal DNA testing requires:

  • An established chain of custody
  • A third-party sample collector
  • Testing performed by our partner AABB accredited DNA Testing laboratory.

At-home DNA testing does not require a chain of custody. Samples are self-collected, and you are responsible for shipping them to the laboratory. It is important to note that New York State prohibits at-home DNA testing.

Avuncular DNA test results are less definitive than a direct parent-child DNA test. A niece or nephew shares an average of 25% DNA with an aunt or uncle, with the range falling between 17% and 34%. Adding the mother to an avuncular DNA test is recommended to strengthen the paternity determination by increasing the accuracy of the DNA analysis.

An aunt or uncle DNA test is an alternative testing option when a biological parent is unavailable to participate in the DNA testing process. The probability of relatedness is 90% or higher for general purposes. However, for legal avuncular DNA testing, results must exceed 99%. All DNA samples are tested on between 18 and 22 genetic markers by our partner AABB accredited lab.

Aunts and uncles share about 25% of the same DNA with their nieces and nephews. It should be noted that 25% of shared DNA between aunts and uncles and nieces and nephews is not a fixed number.

It can range anywhere between 17%–34% of shared DNA. The reason for the varied range is due to genetic recombination during inheritance.
